Player Waiver, Release of Liability and Indemnification Agreement

I acknowledge, agree and understand that:

I voluntarily and of my own free will elect to participate in all activities related to the Somewhat Athletic Society. Furthermore, I agree that I am in good health and proper physical condition to participate in all events and activities. I understand that there are certain risks and hazards involved in participating in the Somewhat Athletic Society that may result in injury or death to me or other players including, but not limited to those hazards associated with playing conditions, equipment, and other participants. I understand that the Somewhat Athletic Society's events/sports/activities are dangerous to me and to other players and may result in serious injury or death. I understand that the very nature of the Somewhat Athletic Society events/sports/activities is hazardous and risky, including, but not limited to, the acts of running, jumping, stretching, sliding, diving, skating and collisions with other players and with stationary objects, all of which can cause serious injury or death to me and to other players.

Further, I agree that in consideration for the right to play in Somewhat Athletic Society sports and activities and in consideration for permission to play:

I voluntarily elect to accept and assume all risks of injury incurred or suffered by me (a) while practicing or playing as a member of the team so designated, (b) while serving in a non-playing capacity as a team member during practice or play by other teams or by other players on my team, and (c) while on or upon the premises of any and all of the space arranged for by my team or league for practice or play. I hereby release, discharge and agree not to sue Somewhat Athletic Society, Nichole Brazil (owner/operator), or their owners, officers, agents, servants, associations, employees, or any person or entity connected with Somewhat Athletic Society for any claim, damages, costs or cause of action which I have or may in the future have as a result of injuries or damages sustained or incurred by me from whatever cause including but not limited to the negligence, breach of contract or wrongful conduct of the parties hereby released.

MEDICAL EMERGENCY AUTHORIZATION

In case of medical emergency, I authorize Somewhat Athletic Society and its representatives to secure necessary medical treatment on my behalf. I agree to be financially responsible for any and all medical costs incurred as a result of such treatment. I acknowledge that Somewhat Athletic Society will attempt to contact my emergency contact, but may act without such contact if immediate medical attention is required.

INSURANCE DISCLAIMER

I understand and acknowledge that Somewhat Athletic Society does not provide medical, accident, or health insurance coverage for participants. I am solely responsible for obtaining and maintaining my own insurance coverage and agree that I will be personally responsible for any medical expenses incurred as a result of participation in Somewhat Athletic Society activities.

FACILITY AND PROPERTY DAMAGE

I agree to be financially responsible for any damage I cause to facilities, equipment, or property during league activities, whether such damage is caused intentionally or through negligence. I will promptly reimburse Somewhat Athletic Society or the facility owner for repair or replacement costs.

CODE OF CONDUCT

I agree to abide by the Somewhat Athletic Society Code of Conduct at all times during league activities. I understand that this includes, but is not limited to, treating all participants, staff, and officials with respect; refraining from aggressive, violent, or unsportsmanlike behavior; and following all league rules and facility policies. I understand that violation of the Code of Conduct may result in immediate removal from the league without refund of any fees paid.

PHOTO AND VIDEO RELEASE

I grant permission to Somewhat Athletic Society to use photographs, videos, or other media of me taken during league activities for promotional purposes including, but not limited to, social media posts, website content, marketing materials, and promotional campaigns. I waive any right to inspect or approve the finished product or any copy that may be used in connection with such media. I understand that I will not receive any compensation for such use.

AGE REQUIREMENT AND PARENTAL CONSENT

I certify that I am 18 years of age or older and have the legal capacity to enter into this agreement.

ACKNOWLEDGMENT

I ACKNOWLEDGE THAT I HAVE READ AND THAT I UNDERSTAND EACH AND EVERY ONE OF THE PROVISIONS IN THIS WAIVER, RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT AND AGREE TO ABIDE BY THEM. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I CONFIRM THAT I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT AND HAVE SIGNED IT FREELY AND VOLUNTARILY.
